undecided on this issue. >> i lot of people still deciding tonight about 30, they will be filling out their ballots. any advice for them? >> yeah, i'd say read the gospel of luke chapter 12 versus 48 where it says, those to whom much has been given, much will be required. that's really what proposition 30 is. it tells those who have done the best, give a little bit back. one or two or three percent for the next seven years to help our schools and colleges in this hour of their need. >> reporter: the governor going biblical on us. but did he go to the seminary so he was right in his mode tonight with people like senator dianne feinstein with mayor ed lee, ronnie lott was up there. of course, willie brown. and the party chair, john burton, all here in san francisco tonight. they will be on the phones later tonight to call people personally and rally them in support of prop 30 and then tomorrow of course we'll have all the results here on cbs 5. back to you. >> thank you, ken bastida. even as governor brown

makes a final push in support of prop 30, a well-funded secretive effort has been at work to defeat it. cbs 5 political analyst phil matier with a look at where the money trail leads. phil. >> reporter: you know, dana, that's one of the mysteries of this election. anonymous donors playing big money in california politics. here's the story. reporter: two conservative groups the virginia-based americans for job security and the center to protect patient rights in arizona collected $11 million and then handed it over to another arizona group, americans for responsible leadership who then sent it over the state line to groups opposed to proposition 30 governor brown's tax hike plan and to groups supporting proposition 32. the measure on tuesday's ballot would limit labor unions from raising and spending political money. as dan newman of the nonpartisan group explains -- >> that contribution came in about 2 weeks ago and as california voters have been casting their early ballots, they have been in the dark about this $11 million.

>> reporter: most of the money went into a last-minute television and radio ad campaign. >> do you think we'll ever know the --who gave the $11 million? >> i don't know. >> reporter: this political science professor says no matter the legal outcome, a move like this damages elections. >> transparency is the lifeblood of democracy. the transactions behind this committee are the equivalent of passing a suitcase in a dark alley. >> reporter: the real question is, who are behind these committees? >> reporter: both the attorney general and the california fair political practice commission is looking into these groups and trying to found out who in fact the donors are. if you look at the websites of the organizations, it's apparent that they are on the conservative libertarian free market side not pro union and not pro tax. on the other hand, it doesn't -- questions are arising about whether they in fact broke any laws, at least federal, because federal law still allows these pacs to exist. the question, when they are

moving that money into california without giving the names of the donors, did they cross a line? that's going to be played out but likely after the election. dana? >> all right, phil matier, thank you very much. in the meantime 800,000 bay area voters have already turned in their ballots and that is roughly the population of san francisco. cbs 5 reporter ann notarangelo asked voters today if they are ready for the campaigning to end. >> reporter: this is definitelicy in action. a steady -- democracy in action a steady stream of voters at the contra costa county elections office the day before the election. the action itself, simple. but the presidential campaign's two years in the making are exhausting. and yet... >> i'm excited about the candidates. i'm excited about my candidate. [ laughter ] >> i'm so excited. i'm happy to be here, yes, to be part of it. >> reporter: weren't they inundated with the same political commercials you and i watched? are you ready for it to be over? >> oh, yeah. i'll be glad by tomorrow night when everything is done. >> we don't have a television.

we haven't seen any ads. >> reporter: do you feel like you have been spared? >> yes. [ laughter ] >> definitely. >> reporter: but to focus on that misses the point says a passionate charlene moore. >> how dare you insult the spirit, the integrity of our people who died so you could vote and don't vote because who vote for the point is vote. >> reporter: even people who often find themselves in the minority consistently vote. >> we try to express the views we would like. we usually lose in california. >> reporter: this person has never been on a winning or losing side before. >> believe it or not, this is my first time doing it. it's been tough time for all of us as you know and i feel like we need to vote because a lot of folks are like, oh, okay, whatever. no, it's not whatever. this is like really important for all of us. >> reporter: this election doesn't seem to have the same electricity as four years ago but that's not to say it

doesn't have a strong current of its own. >> san jose family, friends, family, coworkers, my family, we need to do this. this is going to help us to move forward. >> whatever the attitude, i'm fine with it. i'm not mad. i'm not that happy. but i'm not going to be -- that's not going to stop me from getting up in the morning and doing what i need do. >> reporter: ann notarangelo cbs 5 eyewitness news. >> and the polls open at 7 a.m. and close at 8 p.m. if you have an absentee ballot, do not put it in the mail. drop it off at a polling place or at the registrar's office tomorrow. they are burning jet fuel and the midnight oil. it's so close, president obama and mitt romney are still fighting for every vote in the 11th hour. cbs 5 political reporter grace lee on what we can expect in the last few hours. >> reporter: expect a scramble for every vote and potentially a legal fight if this election is close as it's expected to be. there's so much at stake in

this presidency, our economy, healthcare, and possibly supreme court justice appointments? >> so we've broken election day down hour by hour. here's what to watch for tomorrow. >> reporter: in a last-ditch effort republican nom mitt romney has just added two more campaign stops on election day. cleveland ohio he needs to wind presidency and pittsburgh, pennsylvania. two places to catch closely. what can you expect? at 4 p.m. pacific time the first polls close in virginia. both candidates, wives and running mates have visited this state 90 times in 2012 with a dozen of those visits since friday. at 4:30 pacific time the game could be over in ohio. campaign attorneys and voting rights advocates are ready to fight if this race becomes too close to call. by 5 p.m., all of florida polls will be closed with its 29

electoral votes a grand prize in the electoral count. both candidates have led in the polls at some time with the latest one showing that they are only one point apart. also at 5:00er the polls shut down in pennsylvania a state that has been leaning towards reelecting the president. >> when we do see those results, florida, ohio, pennsylvania, we'll probably tell the tale of this election. if barack obama carries those three states, the election is for all intents and purposes over. mitt romney needs one or probably two of those states in order to fill in his electoral map. >> reporter: so governor romney's added stop in pennsylvania is really a signal that his camp believes he has a shot for those 20 electoral votes. he just started airing tv ads there a week ago. shows what you a big shift that is. but president obama's campaign maintains that they will win pennsylvania. we'll see tomorrow. >> thank you. she had a suspicion and she didn't act on it.

elementary school principal has been found guilty of not reporting suspected abuse by one of her teachers. one of the jurors saying that the principal dropped the ball on protecting her students. cbs 5 reporter len ramirez is outside the courthouse. len. >> reporter: allen, when the district attorney in santa clara county decided to prosecute this case, the message was very clear. they wanted to send a message to those mandatory reporters, people in positions of authority who have the responsibility by law to report when they suspect cases of molestation or abuse. and by getting the guilty verdict today, that message is very clear. >> this was a big failure on a big day. >> reporter: that's how the prosecutor summed up her case against lyn vijkayendran the principal at o.b. whaley elementary school who was found guilty of violating state law by failing to report to police a suspected molest station case that came to her attention. >> reporter: she violated her duties and needed to be held accountable and we needed to be able to send a message to the

rest of the mandatory reporters in our communities that their obligation is to report. not to investigate. >> reporter: the case involved a teacher craig chandler who allegedly blindfolded and molested young girls in his classroom. a parent reported her susspecials. lyn vijkayendran confronted chandler but was convince by the teacher it was a lesson on blindness. jurors say vijkayendran failed in her duties and lacked common sense. >> when up the responsibility of hundreds of children in your care, you can't afforddrop the ball at an important moment like that. it was just -- it was -- she got horrible advice from hr, and she didn't do what she knew she should do. she had a suspicion and she didn't act on it. and the consequences were abominable. >> reporter: and miss vijkayendran was sentenced today, as well. she got 100 hours of community service, a $100 fine and she

will be on probation for the next two years. allen, as for mr. chandler, the alleged molester in this case, his case hasn't got to trial yet. he is awaiting trial in jail. he is facing multiple counts move less station. >> thank you, len ramirez. investigators collected bags of evidence today in fremont where police shot and killed a nasdaq man. they say the 37-year-old had a knife chasing his estranged wife out of her home last night. police say the two officers told him to put the knife down but the naked man didn't. so they shot him. the officers are on paid leave, standard policy. the woman was unhurt. police are looking for a muni rider who tried to rob a hearing-impaired foreign exchange student. investigators say the guy in the brown sport coat and another man pepper sprayed the student and tried to take his backpack. they were unsuccessful. both ran off the bus. police caught one of them and they are still looking for the

man in the sport coat. the man accused of smashing the windshield of a muni bus after the giants world series win says he is sorry. 22-year-old gregory graniss is asking for forgiveness from the public who identified him after' social media manhunt. he pleaded not guilty to two felony counts today. outside court his client says his client acknowledges responsibility for the incident. the d.a. charged 12 others for crimes that same night. >> we want to send a very clear message that you come to san francisco, you celebrate, but if you come here to damage property or hurt people, there will be consequences. >> muni will have to pay for the damage to the bus because the city's insurance policy apparently doesn't cover it. it's a traffic mess in downtown walnut creek. not because we are getting any closer to the holiday shopping season but because an eight- story building is slowly coming down. cbs 5 reporter john ramos with

why this isn't your typical demolition. >> yeah kind of a bummer they can't fix it. >> reporter: evolution is a slow process. and today in walnut creek, it was happening one small bite at a time. these are the final days for the old abandoned bank building at 1500 newell avenue. it became a city icon during the vietnam war when the owners painted a huge peace sign on it that could be seen all overtown earning it the nickname "peace building." at eight stories hire it's also one of the city's tallest buildings. >> so this is walnut creek's skyscraper? >> only skyscraper. >> it's coming down? >> coming down bits and pieces. >> it's sad to see the building come down. you know, it's part of the city's history. >> reporter: but it's not part of the city's future. walnut creek has become a major shopping destination. there are efforts to increase the number of people living in the downtown area. plans for the site include condos and retail to attract

young urban professionals and the old peace building with its 1970s look just doesn't seem to fit in. >> it's a little out of context so you can consider it maybe an icon in its own way but it's definitely time for a change. >> i have been here for 20 years. so it's been there forever. >> reporter: every day, she looks out from her dry-cleaning shop at the old building. she welcomes the new development. but she admits to a bit of sadness too. >> the things that you look forward to but when it gets here, you just kind of, i want it to go. and put a federal receiver n charge of fixing it. that was 7 years ago. there have been improv healthcare for prisoners in california used to be so bad a judge ruled it was unconstitutional and put a federal receiver in charge of fixing it 7 years ago. there have been improvements since including a new medical facilities in stockton. it's billed as a money saver but some question whether lack of care has turned into cadillac care. 40 buildings, 400 acres, one billion taxpayer dollars. one of the state's biggest construction projects is about to wrap up. >> we're very excited. >> reporter: department of corrections secretary matt kate

says the plan is to streamline healthcare for an aging prison population. >> we'll take the sickest patients at the existing prisons as well as the staff associated with caring for those patients and we'll move those to one centralized location. >> reporter: eventually 1700. state's sickest prisoners including mental health and alzheimer's disease patients will be housed here and the project is expected to create thousands of jobs and boost one of the state's most depressed economies. but we have seen this cost- effective scenario before. >> it's going to be a complete waste of money. >> reporter: this corrections officer works at san quentin state prison where a $136 million medical facility opened up just two years ago. >> anything that requires any surgery, anything above -- >> reporter: it's what we discovered earlier this year. despite having 14 doctors on staff, 12 of them board

certified physician surgeons making over $200,000 a year, san quentin still sends prisoners out for medical care. inmates from san quentin took rides to local hospitals almost 5500 times in 2011 alone. some including death row inmates were even spending the night at a sleep clinic at doctors medical center in san pablo. all on the taxpayer dime. >> reporter: why would a brand- new billion-dollar facility that boasts of providing healthcare in a more cost- effective manner have to send patients out for treatment? >> it's not a hospital. it's a skilled nursing facility. >> reporter: nancy kinkead is with the federal receivers office which under court order is still the agency providing medical care for california prisoners. >> they are not licensed for surgery and specialty care. they will need to go out. >> reporter: nearby san joaquin

general is already preparing for the onslaught a 25-bed unit converted to provide security. >> it's not a boondoggle. it would cost even more to build a hospital. >> reporter: but even the state's prison chief admits it won't do much to reduce the budget which has doubled to $1.8 billion this year. >> the reason the state agreed to build the healthcare facility wasn't to cut costs. the reason we decided to build it is we had to -- we have to keep providing better and better and better care until the courts say that it's enough. at one point the receivership wanted to build seven of those and recommended it be $1 billion apiece. and so to have an agreement to build only one seems like a bargain. >> the judge in the lawsuit is beginning to phase out the receivership. justice last week, he allowed the state -- just last week he allowed the state to take control of the stockton facility. it will open next year. coming up in our next half

attention in areas crucial o their strategies to win the white house. and in the final hours, neie now at 6:30, mitt romney president obama and their running mates are focusing on the areas crucial to their strategies to win the white house. and in the final hours, neither one is giving up the fight. cbs 5 political reporter grace lee shows us how both candidates are barreling through key battleground states. grace. >> reporter: that's right, dana. this is a high octane fever pitched push across the nation. both of the candidates are crisscrossing the country fighting for those battleground states and the race is still too close to call. now, mitt romney had a busy day. he spent the day in the states colored in red, florida, virginia and new hampshire.

president obama covered the blue states in the midwest wisconsin and iowa ending with a rally in illinois. now, both candidates visited ohio. the biggest swing state in the contest. [ music ] reporter: what an ending to his final election. the president got a rap from jay-z in ohio this morning. next up, rock star bruce springsteen joining the president on his three-state whirlwind campaign. with all this last-minute rallying, you could hear a hoarseness in his voice. >> when i say, wisconsin, i know what real change looks like you have cause to believe me because you have seen me fight for it and you have seen me deliver it. you've seen the scars on my to prove it. >> because we have more change to do. >> reporter: it is far from over. after wisconsin he went to columbus, ohio and then on to des moines iowa where he started thinks 2008 campaign. -- where he started his 2008 campaign. he will end the night in his hometown of chicago. ♪ [ music ] >> reporter: the president scheduled though seems tame in comparison to governor romney. he has so many stops today, most of his events are in airport hangars so that he can jet in and out to as many locations as possible. >> tomorrow we begin a new tomorrow. perhaps some of your family and friends have not yet made up their minds who they're going to vote for. so ask them to look beyond the speeches and the ads and all the attacks, because talk is cheap. ask them to look at the record. a record is real and it's earned with real effort. the president promised change but change can't be measured in speeches. it's measured in achievement.

>> reporter: his day started in sanford, florida near orlando. then it was on to two stops in virginia before head offing to -- before heading often to the midwest with a quick visit to columbus, ohio. that was just hours after the president's appearance. the gop nomination will end up in manchester, new hampshire with a midnight rally. in a last-minute decision, governor romney's camp has scheduled two more rallies for election day for tomorrow. one in cleveland ohio and one in pittsburgh, pennsylvania. it puts into perspective a couple of things. just how close this race is in ohio, and that the romney camp believes it has a chance in pennsylvania. both candidates were there today and they both believe it's up for grabs. romney's camp thinks he has a chance to take the state. that's a state where they just started running ads about a week ago. >> all right. grace lee, thank you. keep it here for up-to-the-

your neighbor's roof. >> reporter: the storm surge picked his house up off its foundation and dropped it back down a half mile from here. many residents hope to rebuild but correa believes this neighborhood is beyond repair. >> there's no coming back from this. >> reporter: but he is grateful he was able to keep the promise he made to his son to stay alive. >> i thought right there i'm going to break the promise and the kid won't have a father and he will have to live with that for the rest of his life. i couldn't do it. i had to get home to my son. >> reporter: sandy left as many as 40,000 people in new york city homeless. morning a million people in new york and new jersey still don't have power and another storm is on the which. >> the storm could bring more flooding but not of the scale that sandy did. >> reporter: commuting is tough as people wait on long lines for buses, trains an ferries. but one bright spot, most new york city schools reopened today for the first time since sandy hit. alison harmelin for cbs news, staten island. checking bay area headlines, rescue crews cut open the hull of an overturned

boat to free two children trapped inside the cabin. this video is from the sonoma county sheriff's helicopter and it shows how the crews rescued three adults and four children from that boat in tomales bay yesterday. one of the adults suffered a minor injury. everyone else was okay. an evacuation and traffic backup on the embarcadero today after crews accidentally ruptured a gas line. they were trying to install a new fire hydrant. it happened about 10 a.m. at pier 15. it took pg&e 45 minutes to cap the gas leak. nobody was hurt. investigators found this unexploded molotov cocktail at a pleasant hill strip mall damaged by fire last night. they say it started after somebody threw an object through the window of a nail salon on contra costa boulevard. it's unclear what the object was although investigators say it was not a molotov cocktail. no arrests and no injuries reported. day two of the strike at

the bay area are navigating through thousands of strikig workers again. this grocery shoppers across the bay area are navigating through thousands of striking workers again. this has been the scene at nob hill and raley's grocery stores since early sunday morning. after 15 months of failed contract negotiations, employees are upset over cuts to healthcare benefits and pay. some are more concerned about what happens after the strike. >> it's scary.

not knowing if the strike is going to last long or if i'm even going to have a job when i go back. >> but the company argues the only changes are a two-year wage freeze and elimination for bonus pay for sundays and holidays. did you buy your car because of efficiency? fuel economy claims are coming unde scrutiny. cbs 5 consumerwatch reporter julie watts says the epa is about to review mileage claims. >> reporter: car commercials are boasting great gas mileage but last week, the epa discovered two korean carmakers inflated their mileage figures and it seems the agency is taking a closer look now at everyone. it was an epa audit that revealed hyundai and kia boosted their mileage by as much as 13 miles per gallon on 13 models and the agency says that aud sit part of an ongoing

investigation suggesting other carmakers soon come under similar scrutiny. the epa says the guidelines for testing -- it sets those guidelines for testing, and it expects that the industry will follow them. well, hurricane sandy is having a ripple effect across the country and it's threatening the holiday shopping season. with closed ports, flooded warehouses and little gas they are having trouble getting product out of northeast before the looming cutoff for seasonal orders. with the supply chain backing it up could mean less product or pricier product here this holiday season. and in an effort to boost those holiday sales, more stores are moving black friday to thursday. sears announced today it is joining a growing number of retailers to open on thanksgiving day while with sears it's 8 p.m. thanksgiving night to be exact. sears was one of the last holdouts. and kohl's.com is getting an earlier start going live with its black friday online sales at 12:01 a.m. wednesday november 21.
